Online and Live Court Ordered Auction to be held on Monday, November 7th at 10 am at the Plains Community Building, 812 Grand Ave, Plains, Kansas. 

Tract #1 consists of 317 acres total with 4 homes and 148.19 acres of class III dry farmland. Farms 1, 2, and 8 are located on tract #1. There are gravel and dirt roads accessing them from the county roads Additionally tract #1 has a large shop building and machine shed. The farmland on tract #1 is level, and is all class III soils. 

Farm #1 has swine buildings, office/shop, covered shipping with chutes, generator shed with backup generator. There are 4 breeding and gestation barns, 15 farrowing barns, 12 nursery barns, 5 grower barns, and 9 finish barns. The swine buildings have concrete foundations and stem walls, metal sides and roofs. They are insulated, with partial or full slat floors with dump bucket flushes and forced air heaters. All the sows are fed manually and the nursery to finish buildings have flex auger feed lines. The buildings each have at least one overhead bin feeding the feed line or a down spout for filling feed carts for the sows. They are power ventilated and cooled with exhaust fans, cool cells and drop curtains and or eave baffles. Each building is equipped with crates/pens to accommodate the type of swine for which it was designated. There are six finish buildings that have been demolished and only their foundations remain. Currently there is capacity for 1,555 sows and 10,600 market pigs (nursery to finish). 

In addition to the swine buildings there is an office/shop that is 2,400 sf with 960 sf office space with break room and restrooms, and 1,440 sf of shop area with full concrete floor. There is a covered shipping pen with two load-out chutes located just north of the office and a generator shed with a backup generator located southeast of the office. 

Farm #2 consists of 51 swine buildings, office/shop, covered shipping pen with chutes, generator shed with backup generator. There are four breeding and gestation barns, 15 farrowing buildings, 12 nursery barns, 5 grower barns, and 15 finish buildings. The swine buildings have concrete foundations and stem walls, metal sides and roofs. They are insulated, with partial or full slat floors with dump bucket flushes and forced air heaters. All the sows are fed manually and the nursery to finish buildings have flex auger feed lines. The buildings each have at least one overhead bin feeding the feed line or a down spout for filling feed carts for the sows. They are power ventilated and cooled with exhaust fans, cool cells and drop curtains and or eave baffles. In addition to the swine buildings there is a 2,400 sf office/shop with 960 sf of office space with break room and restrooms, and 1,440 sf of shop area with full concrete floor. There is a covered shipping pen with loadout chutes, a generator shed with a backup generator. 

Farm # 8 consists of swine buildings, office/shop, generator shed with backup generator, load out chute.  The swine buildings consist of three breeding and gestation barns, 12 farrowing buildings, 7 nursery barns, and three grower barns. The swine buildings have concrete foundations and stem walls, metal sides and roofs. They are insulated, with partial or full slat floors, and the B&G buildings are equipped with dump bucket flushes. The buildings have hanging, forced air heaters. All the buildings have flex auger feed lines. The buildings each have at least one overhead bin feeding the feed lines. They are power ventilated and cooled with exhaust fans, cool cells and drop curtains and or eave baffles. Each building is equipped with crates/pens to accommodate the type of swine for which it was designated. Currently there is capacity for 1,760 sows, 3,600 nursery pigs, and 400 grower pigs. In addition to the swine buildings there is a 2,880 sf office/shop building with 1,872 sf of office space with break room and restrooms, and 1,008 sf of shop area with full concrete floor. There is a generator shed with a backup generator, two load-out chutes. 

In addition to the three swine facilities on the subject property there is a shop, machine shed and four employee houses. The shop building was built around 1993 and is 3,200 sf (40X80), metal frame with metal sides, full concrete floor, insulated, heated, with electric and water, office area with one overhead door, two sliding end doors and a sliding side door. It also has windows and two walk-through doors. The older machine shed is 6,000 sf (40X150) with concrete floor, metal sides and roof. It has two sets of sliding doors, an overhead door and a walk-through door. It also has a heated, lighted, and insulated shop area. There are two dwellings along the county road on the east side and two along the county road on the west side. They were built in 1980, and range from 1,200 - 1,400 sf. They have vinyl siding and asphalt shingle roofs.

TERMS AND CONDITIONS OF AUCTION

Live and Online Bidding

1. LIVE BIDDING: United Country - Commercial will offer this property for public auction on Monday, November 7th, 2022. Auction location will be at the Plains Community Building, 812 Grand Ave., Plains, KS. At 10:00 AM, the property will be offered in a Multi-Par format. Conduction of the auction and increments of bidding are at the direction and discretion of United Country - Commercial and/or the auctioneers. If a tie or dispute occurs between two or more bidders, the Auctioneer may re-open the bidding at the Auctioneer’s sole discretion and shall serve as the sole arbiter as to who is or is not allowed to bid. The Auctioneer reserves the right to reject any bid which is only a fraction advance over the preceding bid, to regulate bidding and to accept or reject any or all bids. The Auctioneer reserves the right to enter bids on behalf of absentee/phone bidders as well as the Sellers. Any and all decisions of the Auctioneer regarding the conduct of the auction shall be final and absolute without liability to any party. Each bid shall constitute an offer to purchase, and the final bid, if accepted by the Sellers, shall constitute a binding contract between the Buyer and Sellers.

 

2. BIDDING REGISTRATION: This is a live and online auction. You will need to register in person to bid for live bidding and agree to all terms. If you choose to bid online you will need to register online to bid and agree to all terms. 4. SERVER & SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, United Country - Commercial reserve the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor UNITED COUNTRY - COMMERCIAL AND OR AGENTS AND EMPLOYEES SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.

 

5. FINANCING: By participating in this auction, bidders hereby agree that their bid shall NOT BE SUBJECT to the bidders’ ability to obtain financing. By placing a bid in this auction, bidders understand that financing is NOT a contingency in the purchase agreement.

 

6. APPROVAL OF BIDS: Seller is serious about selling this property at this auction, but does reserve the right to accept or reject the final bid on this property. Each bid shall constitute an offer to purchase, and the final bid, if accepted by the seller, shall constitute a binding contract between the Buyer and the Sellers. The successful bidder must enter into a purchase agreement the day of the auction, immediately following the conclusion of the bidding.

 

7. ACCEPTANCE OF FINAL BID: Winning bidder hereby agrees to enter into a Contract to Purchase the property immediately following the auction and being declared the Successful Bidder by the Auctioneer.

 

8. DEED AND EVIDENCE OF TITLE: Seller will pay the cost of title insurance in the amount of the selling price and Seller will deliver title by Quit Claim Deed. Informational title commitments reflecting the public record will be made available for potential buyer for review on day of auction or, by request, earlier.

 

9. PROPERTY / TITLE INSPECTION: It is recommended to all bidders to inspect the property prior to placing any bids in the auction. Property viewing day will be October 7th from 8 am to 4 pm at the main office. Property inspections are the responsibility of the bidders. Informational title work will be available online by October 5th.

 

10. DOWN PAYMENT / ESCROW: An escrow deposit of Ten Percent (10%) of the total contract purchase price must be received by American Title & Abstract Specialists in Liberal, KS within 24 hours of the close of the auction. Acceptable forms of payment include cashier’s check, personal, corporate check or wire transfer. The balance will be due in full at closing, in certified funds, on or before the date of closing. Contracts will contain no financing or inspection contingencies and Buyer must have their own financing and make their own inspections prior to bidding at this auction.

11. CLOSING & CLOSING COSTS: Closing shall be on or by December 7, 2022 at American Title & Abstract Specialists in Liberal, KS. Out of area buyers will be afforded the opportunity to close via email, mail and wire transfer of certified funds. Title commitment and owner’s policy will be paid by the Seller. Seller will deliver title by Quit Claim Deed. Buyer will be responsible for their own mortgage policies or exchange fees (if applicable). Customary closing fees in the county where the property is located will apply to both Seller’s and Buyer’s transactions accordingly.

 

12. TAXES: 2022 Real Estate Taxes will be pro-rated to day of closing.

 

13. POSSESSION: Purchaser shall receive possession of the property at closing.

 

14. EASEMENTS: The property is being sold subject to all easements, covenants, conditions, zoning and any other existing matters.

 

15. MINERAL RIGHTS: All mineral rights owned by the Sellers will be conveyed to the Buyer.

 

16. WATER RIGHTS AND WASTE WATER PERMITS: All water permits and waste water permits owned by Sellers shall convey to the Buyer.

 

17. HOLD HARMLESS: Buyer and or Bidder agrees to hold harmless and indemnify United Country - Commercial and its Agents, Owners, and/or Employees and its Representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc.
